The Education Department has a duty to include a child with special needs in a mainstream school, so long as:

• the child's needs are properly met

• other children's education is not adversely affected

• resources are being used efficiently

• and parents are in agreement.

However, the Education Department may include a child in a mainstream school even when parents want a special school if the special school is not appropriate. In this situation parents can appeal to a Tribunal.
