Mental Health Act 1983

Sometimes it can happen that a person with a learning disability has a mental health issues or shows severely disturbed behaviour and refuses the treatment or care they need.

In these circumstances an assessment for compulsory treatment or care can be made under the Mental Health Act 1983. These assessments are made by an approved social worker and two approved doctors, the same as for anyone with mental health issues.

The Mental Health Act is very complex and covers a number of different areas, including compulsory admission, guardianship, patients concerned in criminal proceedings, consent to treatment and right to appeal.
